Terms of Service

1. Acceptance

These terms form an agreement between you and Rayona Digital, operator of Postvella. By creating an account, using the service, or making a purchase, you agree to these terms and our privacy policy.

2. The Postvella service

Postvella lets you choose or create a template, personalize an invitation, upload contacts, pay for delivery, send an image and personal link by MMS, and view RSVPs. Certain features may be tested, changed, or removed for security or operational reasons.

3. Account and security

You must provide accurate information, protect your password, and promptly notify us of unauthorized use. You are responsible for actions taken through your account, except where they result from Postvella’s fault.

4. Content and rights

You retain your rights in text, photos, and other content you upload. You grant Postvella a limited permission to host, technically adapt, and transmit that content solely to provide the service.

You confirm that you have all necessary rights and permissions. You must not upload content that is unlawful, deceptive, hateful, threatening, infringing, or that violates another person’s rights.

5. Contacts, consent, and MMS

You must have the right to use each recipient’s contact information and send the invitation. You are responsible for the sender name, event name, and content transmitted. Recipients may reply STOP to opt out of applicable messages. Promotional or unsolicited use of the service is prohibited.

6. Artificial intelligence creation

AI-generated images may contain errors, resemble existing elements, or not fully match your instructions. You must review the result before using it. You must not request unlawful content or include unnecessary sensitive information in your prompts.

7. Prices, taxes, coupons, and payment

Prices are shown in Canadian dollars before tax unless stated otherwise. Applicable taxes and the final total are presented before payment confirmation. Payments are processed by Stripe. A coupon is valid only under its stated conditions and cannot be redeemed for cash.

You must review the invitation, recipients, price, and MMS message before paying. A transaction confirmation is sent by email.

8. Cancellation and refunds

You may edit or abandon a draft before payment. Once payment is confirmed, the sale is final and no discretionary refund is provided, including for a change of mind, an error in content or contact details, or a cancelled event.

The separately published Refund Policy forms part of these Terms. Mandatory consumer-protection rights and remedies applicable to duplicate or unauthorized payments or services not provided remain in effect.

9. Delivery and availability

MMS delivery depends on the number provided, devices, mobile carriers, spam filters, and external providers. Postvella does not guarantee that a message will be received or read at a particular time. We use reasonable efforts to keep the service available but do not promise uninterrupted availability.

10. Prohibited uses

• Send spam, unsolicited messages, or fraudulent content.
• Bypass limits, security, payments, or unsubscribe mechanisms.
• Use the service to harass, threaten, impersonate, or violate the law.
• Attempt to access another person’s account, invitations, or data.

11. Suspension or termination

We may suspend or close an account when reasonably necessary to protect users, prevent fraud, comply with law, address non-payment, or stop a material violation of these terms. Where practical, we will notify you and provide an opportunity to correct the issue.

12. Liability

To the extent permitted by law, Postvella is not responsible for delays or failures caused by incorrect information, mobile carriers, the Internet, Stripe, Twilio, OpenAI, or other circumstances beyond its reasonable control. Nothing in these terms limits liability or consumer rights that cannot legally be excluded.

13. Governing law

These terms are governed by the applicable laws of Québec and Canada. Mandatory consumer protections in your province or territory continue to apply.

14. Changes and contact

We may update these terms. The version published at the time of your purchase applies to that transaction. For questions, email notifications@postvella.com.
